Disclosure Scotland – The Protection of Vulnerable Groups (Scotland) Act 2007: Section 35 (2) and (3)

The Scottish Government is currently consulting on proposed changes to legislation preventing employers from employing barred individuals to do regulated work.  The legislation currently prevents employers from knowingly employing someone on the barred list.  One of the proposed changes is to make it an offence to employ a barred individual to do regulated work regardless of whether they have been notified by Disclosure Scotland that the individual is barred from that work.  In effect, this change would make PVG checks mandatory.
